Terms of Use

These Terms of Use (“Terms”) govern your access to and use of ClosetCheck—the iOS/iPadOS app, website at closetcheck.app, and related services operated by ClosetCheck (“we,” “us,” or “our”). By downloading, accessing, or using ClosetCheck, you agree to these Terms. If you do not agree, do not use the service.

1. Acceptance of these Terms

ClosetCheck is a consumer app that helps you build a digital closet, identify clothing, organize outfits, and shop more thoughtfully against what you already own. These Terms form a binding agreement between you and ClosetCheck. Additional notices in the app (for example feature-specific prompts) may also apply.

Our Privacy Policy explains how we handle personal information and is incorporated by reference for that purpose.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your region to use online services) to create an account. If you are under the age of majority where you live, you may use ClosetCheck only with a parent or guardian’s permission and supervision to the extent required by law.

You represent that you can form a binding contract and that you will comply with these Terms and applicable law.

3. Your account

You may need an account to use ClosetCheck. You can sign in with email, Sign in with Apple, and (when enabled) Google. You are responsible for:

  • Keeping your sign-in methods secure
  • Activity that occurs under your account
  • Providing accurate information

Notify us promptly at hello@closetcheck.app if you believe your account has been compromised. We may suspend or terminate accounts that appear abandoned, abusive, or insecure.

4. License to use the app

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use ClosetCheck on Apple devices you own or control, solely for your personal, non-commercial use, as permitted by the App Store terms and these Terms.

You may not:

  • Copy, modify, or create derivative works of the app except as allowed by law
  • Reverse engineer, decompile, or attempt to extract source code except where legally permitted
  • Rent, lease, sell, sublicense, or redistribute the app
  • Remove proprietary notices
  • Use ClosetCheck to build a competing service using our non-public materials

Apple Inc. is not a party to these Terms and is not responsible for ClosetCheck or its content. Your use of the app is also subject to Apple’s App Store terms. Apple and Apple’s subsidiaries are third-party beneficiaries of this section to the extent required by Apple’s standard EULA framework.

5. Your content

“Your Content” includes photos, closet items, outfits, notes, sizes, purchase details, wear and borrow logs, “My Model” / try-on references, and other materials you upload or create.

You retain ownership of Your Content. You grant ClosetCheck a worldwide, non-exclusive license to host, store, process, transmit, and display Your Content solely as needed to operate and improve the service you request—including AI identification, catalog matching, sync, and backup.

Closets are private by default. Sharing is explicit. The shared product catalog contains products, not people’s closets. Ownership, purchase, wear, and borrow history are not published as public catalog data. Settings such as Hide From Public and Keep Product Private further limit how related information appears outside your private space.

You represent that:

  • You have the rights needed to upload and use Your Content in ClosetCheck
  • Your Content does not infringe others’ rights or violate law
  • Photos of other people (including try-on references) are used only with appropriate permission

We may remove content that appears to violate these Terms or create risk for users or the service.

6. AI features and product matching

ClosetCheck uses automated systems—including AI models and external product search providers—to help identify clothing, rank matches, extract tags, and (in limited cases) generate imagery. Processing runs through our secure server-side infrastructure; provider API keys are not embedded in the app.

You understand and agree that:

  • AI and search results can be wrong, incomplete, outdated, or biased
  • Product matches, attributes, prices, and availability are estimates or candidates until you confirm them
  • ClosetCheck is not a substitute for your own judgment about fit, authenticity, safety, or purchasing decisions
  • We may ask you to confirm results before creating or enriching catalog records
  • External catalogs and search providers (such as Shopify Catalog or other shopping/visual search tools) may be queried when our internal catalog does not find a confident match

Features may change, rate-limit, or become unavailable as providers, costs, and product design evolve.

7. Prohibited use

You agree not to:

  • Violate any law or another person’s rights
  • Upload illegal, exploitative, or harmful content
  • Attempt to access other users’ private closets or data without authorization
  • Probe, scan, or overload our systems; bypass rate limits; or interfere with the service
  • Scrape, harvest, or bulk-export ClosetCheck data except through features we provide for your own account
  • Misrepresent product ownership, authenticity, or identity in a way that deceives others
  • Use ClosetCheck for spam, malware, surveillance of others, or commercial data mining without our written permission
  • Use automated bots except as we expressly allow

8. Intellectual property

ClosetCheck—the app, branding, design, software, documentation, and our product catalog structure—are owned by ClosetCheck or our licensors and protected by intellectual property laws. These Terms do not transfer ownership of our IP to you.

Third-party product names, images, and trademarks belong to their respective owners. Display of a product in ClosetCheck does not imply endorsement by that brand unless we say so.

If you believe content in ClosetCheck infringes your copyright, contact hello@closetcheck.app with enough detail for us to investigate.

9. Third-party services and links

ClosetCheck depends on third parties for hosting, authentication, AI, and product search. Their services are governed by their own terms and privacy policies. We are not responsible for third-party websites, stores, or offerings you visit from ClosetCheck, including purchase transactions completed outside our app.

10. Disclaimers

ClosetCheck is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The app will be uninterrupted, secure, or error-free
  • AI identifications or catalog matches will be accurate
  • Product data or prices from third parties will be current
  • Defects will always be corrected

Some jurisdictions do not allow certain disclaimers; in those places, disclaimers apply to the maximum extent allowed.

11. Limitation of liability

To the fullest extent permitted by law, ClosetCheck and its operators, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from your use of (or inability to use) ClosetCheck.

Our total liability for any claim arising out of or relating to these Terms or the service will not exceed the greater of (a) the amounts you paid us for ClosetCheck in the twelve (12) months before the claim, or (b) fifty U.S. dollars (US $50).

These limits apply even if a remedy fails of its essential purpose. Some places restrict liability limits; where they do, we limit liability to the maximum extent allowed.

12. Termination

You may stop using ClosetCheck at any time and may request account deletion as described in our Privacy Policy (in-app when available, or by emailing privacy@closetcheck.app).

We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if we discontinue the service. We will try to provide notice when reasonable. Sections that by their nature should survive (including IP, disclaimers, limitation of liability, and governing law) will survive termination.

13. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law rules, except where mandatory consumer-protection laws in your place of residence require otherwise.

Courts located in California will have exclusive jurisdiction over disputes arising from these Terms, except that you may bring qualifying consumer claims in your local courts where required by law. We may update this section if ClosetCheck establishes a more specific legal entity or venue; material updates will be reflected in a revised “Last updated” date.

14. Changes to these Terms

We may revise these Terms from time to time. We will update the “Last updated” date and, for material changes, provide notice in the app or by other reasonable means. Continued use after changes take effect constitutes acceptance of the updated Terms. If you do not agree, stop using ClosetCheck and delete your account.
